terms of service

these terms of service (“terms”) govern your access to and use of the photobanquet mobile application and related services (collectively, the “service”) operated by photobanquet inc. (“we,” “us,” or “our”). by creating an account or using the service, you agree to these terms.

1. eligibility

you must be at least 18 years old to use the service. by using the service, you represent that you meet this requirement and have the legal capacity to enter into these terms.

2. the service

photobanquet provides temporary, private photo albums (“banquets”) for events. banquets are accessed by invite link or qr code, have a set duration chosen by the host, and are designed for participants to upload and view event photos together.

the app also includes:

• friends — connect with people you know to see their banquet highlights on your feed
• banquet highlights — pick up to twelve photos from a banquet to share on your feed for friends
• feed & comments — view friends’ highlights and comment on posts
• notifications — optional alerts for friend requests, banquet invites, new photos, and similar activity
• host tools — banquet creators can invite members, set a cover photo, and remove members when appropriate

3. your account

you sign in using a phone number and one-time verification code (sms otp). there is no separate password. you are responsible for maintaining access to your device and number and for all activity under your account.

you may permanently delete your account at any time in the app under profile → settings → delete account. deletion removes your profile and releases your phone number for future sign-up. photos you uploaded to banquets may remain visible to other members until those banquets expire.

4. sms verification program

photobanquet sends sms one-time verification codes when you sign in or verify your account. by requesting a verification code in the app, you consent to receive these messages.

1. photobanquet — account verification and sign-in codes.
2. you can cancel sms from this program at any time by replying stop to a message from us. we will send one confirmation text that you have been unsubscribed. after that, we will not send further sms until you request a new verification code in the app, which constitutes a new opt-in for that login attempt.
3. if you need help with sms from photobanquet, reply help or contact us at help@photobanquet.com or photobanquet.com/support.
4. carriers are not liable for delayed or undelivered messages.
5. message and data rates may apply for messages sent to you and from you. message frequency varies (typically one message per login attempt). contact your wireless provider with questions about your text or data plan.

5. user content

you retain ownership of photos, comments, and other material you submit (“user content”). you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display user content solely to operate and improve the service (for example, showing photos to other members of a banquet you joined or highlights to your friends).

zero tolerance. we have no tolerance for objectionable content or abusive users. you agree that you will not upload, post, or share user content that:

• violates any law or third-party rights
• is illegal, harassing, hateful, defamatory, obscene, sexually exploitative, or violent
• bullies, threatens, or endangers any person
• contains malware or attempts to disrupt the service
• you do not have permission to share

we may use automated and manual review to detect prohibited content. we are not obligated to monitor all user content but may remove content, restrict features, suspend, or terminate accounts that violate these terms.

6. community safety, reporting, and blocking

because the service includes user-generated content, we provide ways for you to keep your experience safe:

• report content — flag photos or comments you believe violate these terms through in-app tools (where available) or by emailing help@photobanquet.com
• block users — block another user so their content is removed from your feed immediately and they cannot interact with you through the service. blocking also notifies us of the concern so we can review it
• our response — we review reports of objectionable content and aim to act within 24 hours by removing violating content and taking action against the account that posted it, including suspension or removal from the service

in-app report and block tools are available from profiles, photos, and comments. you can also contact help@photobanquet.com with screenshots and the username or context of the content you are reporting.

7. banquet hosts and participants

banquet creators may invite others and set event duration. participants should only join banquets they are invited to and should respect the privacy of other guests. we may remove content or restrict access that violates these terms or applicable law.

8. temporary nature of banquets

banquets expire after the period chosen by the host. when a banquet ends, new uploads may be disabled. banquet highlights you published may remain visible according to in-app settings until you remove them.

9. acceptable use

you may not misuse the service, attempt unauthorized access, scrape or reverse engineer the app, or use the service for unsolicited commercial messaging.

10. disclaimers

the service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. we do not guarantee uninterrupted or error-free operation.

11. limitation of liability

to the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the service. our total liability for any claim relating to the service is limited to the greater of (a) amounts you paid us in the twelve months before the claim or (b) one hundred u.s. dollars (us$100).

12. termination

you may stop using the service at any time or delete your account in the app (see section 3). we may suspend or terminate access if you breach these terms, if we receive valid reports of abuse, or if required for legal or security reasons.

13. changes

we may update these terms from time to time. we will post the revised terms on this page and update the “last updated” date. continued use after changes become effective constitutes acceptance.

14. governing law

these terms are governed by the laws of the province of ontario and the federal laws of canada applicable therein, without regard to conflict-of-law rules. courts in that jurisdiction will have exclusive venue for disputes, unless applicable law requires otherwise.
